By accessing this website (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms") in a legally binding agreement between the Merchant and you (the "User"). Please read these Terms carefully before using the Platform. If you do not agree to the Terms, you may not access the Platform. We may update these Terms from time to time by posting changes here; continued use of the Platform after changes are posted means you accept the revised Terms.

Eligibility

You represent and warrant that you have the right, power, and authority to agree to these Terms, to become a party to a legally binding agreement, and to perform your obligations hereunder.

Definitions

  • Payment Instrument — credit card, debit card, bank account, prepaid payment instrument, UPI, IMPS, or any other payment method developed, added, or deployed by banks and financial institutions from time to time.
  • Platform — this website, peakreign.in, where the Merchant offers its products and a Transaction may be initiated.
  • Transaction — an order or request placed by a User with the Merchant to purchase products listed on the Platform by paying the Transaction Amount.
  • Transaction Amount — the amount paid by a User in connection with a Transaction.
  • User(s) — any person availing the products offered on the Platform.

Merchant's Rights

We may collect, store, and share information you provide in order to deliver the products you've availed on the Platform, and/or to contact you in relation to the same.

Your Responsibilities

You agree to provide true, complete, and up-to-date information about yourself as required to complete a Transaction — including personal details such as name, email address, phone number, and delivery address — as well as accurate payment information.

Products, Pricing, and Payment

  • All products are subject to availability; we may limit quantities or discontinue any product at any time.
  • Prices are listed in Indian Rupees (INR).
  • Payments are processed through our third-party payment gateway. We do not collect or store your full card, UPI, or bank account details on our servers.
  • If a pricing or listing error is discovered after you've placed an order, we will contact you before proceeding, and you may cancel for a full refund.

Prohibited Actions

As a User of the Platform, you agree not to:

  • Systematically retrieve data or content from the Platform to build a collection, compilation, database, or directory without our written permission.
  • Make unauthorized use of the Platform, including collecting other users' information for unsolicited communication, or creating accounts by automated means or false pretenses.
  • Circumvent, disable, or interfere with the Platform's security-related features.
  • Trick, defraud, or mislead us or other users, including attempts to learn sensitive account information.
  • Misuse our support services or submit false reports of abuse.
  • Use automated means (scripts, bots, data mining tools) to interact with or extract data from the Platform.
  • Interfere with or disrupt the Platform or the networks/services connected to it.
  • Impersonate another person, or use another user's identity.
  • Use information from the Platform to harass, abuse, or harm another person.
  • Use the Platform to compete with us or for an unrelated revenue-generating or commercial purpose.
  • Decipher, decompile, disassemble, or reverse-engineer any Platform software.
  • Attempt to bypass measures designed to restrict access to the Platform.
  • Harass, threaten, or intimidate our employees or agents.
  • Copy or adapt the Platform's software or code.
  • Upload or transmit viruses, malicious code, or spam that disrupts the Platform.
  • Disparage or harm us or the Platform.
  • Use the Platform in a manner inconsistent with applicable laws.

Limitation of Liability

If you receive a defective product, or a product that does not match its description, your recourse is to initiate the refund/exchange process under our Refund and Cancellation Policy. We disclaim liability beyond that process. You agree to indemnify and hold harmless the Merchant and its affiliates, agents, and representatives from claims, damages, and costs arising from your breach of these Terms.

Guidelines for Reviews

If we provide areas for reviews or ratings, your reviews must:

  • Reflect firsthand experience with the product/business being reviewed.
  • Not contain profanity, abuse, hate speech, or discriminatory content.
  • Not reference illegal activity, and not be false or misleading.
  • Not be posted if you're affiliated with a competitor and posting negatively.
  • Not be part of an organized campaign encouraging others to post reviews.

We may accept, reject, or remove reviews at our discretion, and by posting a review you grant us a perpetual, non-exclusive, worldwide, royalty-free license to reproduce, modify, and display that review content.

Governing Law & Dispute Resolution

These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute. Any dispute arising out of or relating to these Terms shall be referred to and finally resolved by arbitration in Bengaluru, in accordance with the Arbitration and Conciliation Act, 1996. Within 30 days of a notice of dispute, the parties shall mutually agree on a sole arbitrator; failing that, the arbitrator shall be appointed per the Act. The seat of arbitration is India, proceedings are in English, and the arbitration is kept confidential. Each party bears its own cost of arbitration, reimbursed as directed in the arbitral award. This does not preclude either party from seeking injunctive relief from courts in Bengaluru where appropriate.

If you have a question or complaint about a product or Transaction — including double debit, a fraudulent or unauthorized transaction, or a refund request — email us at peakreign101@gmail.com. Disclaimer

By initiating a Transaction, you enter into a legally binding contract with us to purchase the listed products, and agree to pay through legitimate, accepted payment methods. Payment details you provide may be shared with third parties where required for fraud verification or by law/regulation/court order. We disclaim liability for unauthorized use of your Payment Instrument; all payments are undertaken at your own risk. We are not liable for loss or damage from declined authorization, malfunction, errors, or fraudulent activity by third parties. Treat any user identification code, order ID, or password as confidential and do not disclose it. Content on the Platform is provided for general information only and should not be relied upon as advice. Links to third-party websites are provided for information only and are not an endorsement. We do not guarantee the Platform is free of bugs or security vulnerabilities; you are responsible for your own device security.
